This spring, the Environmental Protection Agency (EPA) and the Army Corps of Engineers (Corps) issued an Interpretive Rule (IR) with the intent of clarifying the scope of the normal farming, ranching, and silvicultural exemptions under Section 404(f)(1)(A) of the Clean Water Act. The House Agriculture Committee held a hearing to review the IR and hear the concerns of impacted stakeholders. While the agencies have asserted that the IR would broaden the scope of the existing agricultural exemptions, it has since become clear that nothing could be further from the truth.
