Dear Colleague,

Please join us as a cosponsor to H.R. 6485, the Recovery Rebates Improvement Act (RRIA), to ensure that mixed status households can be eligible for the same cash relief as overseas, mixed status military joint filers under Public Law 116-136 (CARES
Act).

As you know, the recovery rebates, established in Section 2201 of the CARES Act, are one-time stimulus payments of $1,200 for most adults over the age of 18 and $500 for children under the age of 17. Unfortunately, many noncitizens and mixed status families
were intentionally left out of receiving such payments in the Senate compromise bill. The CARES Act requires identification to qualify for these rebates but only in the form of a Social Security Number (SSN). Under current statute, couples filing jointly with
any non-SSN identification will not be eligible for these emergency checks whatsoever. This means that such joint filers are not going to receive any cash relief, even if one of them has a SSN but the other does not. It is just absurd
and cruel that a taxpaying, mixed status couple or family could be excluded from this vital assistance.

That is why I have introduced the RRIA to fix this major error by expanding
the special rule
for the military in the CARES Act, which exempts the joint returns of military joint filers from such strict ID eligibility, to all other applicable joint filers. While more comprehensive legislation is needed in the next package to include all
ITIN holders and other noncitizens for this kind of relief, I hope you can support this commonsense bill as a first step to make sure that all eligible joint filers can receive these relief payments. There is no reason why we can establish this sensible carve-out
for military families, based on little to no statutory precedent from stimulus legislation, and not expand and apply this same eligibility standard to all others.
