Please join me in cosponsoring H.R. 4138, the State Veterans Home Inspection Simplification Act.
State Veterans Homes (“SVHs”) are facilities that provide eligible Veterans with nursing home, domiciliary, or adult day care. These high-quality facilities are owned and operated by state governments, and each state establishes eligibility and admission
criteria for its homes. Some SVHs may admit non-Veteran spouses and gold star parents. As of July 2019, there were 148 State Veterans Homes across the United States, proudly providing care to over 20,000 veterans.
Currently, the law mandates that all SVHs be subject to annual unannounced inspections by the VA to maintain their certification. For an SVH to be eligible for Medicare/Medicaid payments from CMS, it must also complete an annual unannounced CMS inspection;
about two-thirds of SVHs accept CMS payments. The VA and CMS inspections have nearly identical requirements. Therefore, two-thirds of all SVHs are required to undergo essentially the same evaluation twice a year by two different government agencies.
These inspections can be disruptive to the veterans who reside in the homes and force SVH staff to divert their time and energy away from their daily duties.
State Veterans Home staff should focus on their patients, not on unannounced surveys.
H.R. 4138 allows SVHs to forgo a CMS inspection if they meet all the requirements of a VA inspection. This would allow SVHs to only have to undergo one inspection per year. H.R. 4138 is a commonsense fix that will help our nation’s veterans
continue to receive high quality care by facilities unburdened by bureaucratic overlap.
