Wages Should be Based on Merit, Not Salary History

Please cosponsor the Pay Equity for All Act (H.R. 1864), which seeks to help eliminate the gender and racial pay gaps by prohibiting employers from asking job applicants for their salary history before making a job or salary offer. The text of the Pay Equity
for All Act was included in the House-passed Paycheck Fairness Act (H.R. 7).
Even though many employers may not intend to discriminate against applicants or employees based on gender, race or ethnicity, setting wages based on salary history can unfairly reinforce the wage gap. Members of historically disadvantaged groups often start
their careers with unfair, artificially low wages compared to their white male counterparts, and the disparities are compounded from job to job throughout their careers.
Our bill, enforced through the Equal Employment Opportunity Commission, would ensure that salary offers made to applicants are based on their skills and merit, not arbitrarily on salary history, by assessing penalties up to $10,000 against employers who
ask applicants for their salary history during the interview process or as a condition of employment or continued employment. It will also provide job applicants and employees with a private right of action against employers who violate these provisions,
allowing them to collect up to $10,000 in damages and attorney’s fees.
