Dear Colleague,

I invite you to cosponsor H.R. 1421, the Help Americans Never Get Unwanted Phone-calls (HANGUP) Act of 2019, to restore protections for consumers and reduce a significant percentage of unwanted robocalls.

Last year, Americans received 48 billion robocalls, and they are the source of the #1 consumer complaint to the Federal Communications Commission (FCC) and the Federal Trade Commission. Stunningly, one of the most dominant sources of robocalls are debt collectors
working on behalf of the federal government.

The Telephone Consumer Protection Act protected consumers against all unwanted robocalls, until a provision in the Bipartisan Budget Act of 2015 created a loophole that allows companies collecting debt owed to or guaranteed by the federal government to robocall
borrowers without consent. Millions of students, veterans, farmers, small businesses, and homeowners have this kind of debt.

The HANGUP Act is bipartisan, bicameral legislation to repeal a loophole allowing contractors to robocall anyone with debt owed to or guaranteed by the federal government. This includes most student loans and many loans to veterans, farmers, and
small businesses.

On April 24, 2019, a Fourth Circuit Court of Appeals decision strengthened the need for the
HANGUP Act because the court found the 2015 loophole to be unconstitutional. (American Association of Political Consultants, Inc, et. al, v. FCC). The
HANGUP Act ensures that Americans struggling to pay off debt are protected from abusive robocalls.

The HANGUP Act is supported by Consumer Reports, the National Consumer Law Center on behalf of its low-income clients, the Consumer Federation of America, Consumer Action, and the National Association of Consumer Advocates.

You constituents and mine are fed up with robocalls. While there isn’t a silver bullet to stop all robocalls, there are policies we can put in place to reduce them significantly. The HANGUP Act is a critical part of that goal and one I think is
easily achievable.
