An Update on the U.S. Department of Labor’s Overtime Rule

Dear Colleague:

Congressman Mark Takano (D-CA)  invites you to a Congressional staff briefing on an update to the U.S. Department of Labor’s (DOL) proposed rulemaking governing overtime exemptions from the Fair Labor Standards Act (FLSA).  As you may know, DOL is expected
to promulgate new rulemaking later this month that will propose a $35,000 salary threshold for overtime pay – a number that falls dramatically short of what is needed to bring overtime compensation up to date for our current economy.

You will have the opportunity to hear from a panel of experts in this field, including:

  • Judy Conti, Government Affairs Director, National Employment Law Project
  • Heidi Shierholz, Senior Economist and Director of Policy, Economic Policy Institute
  • Anne Babcock-Steiner, Senior VP of Human Resources, Pathstone

The Obama-era overtime rule, which would have increased the cap to nearly $50,000 annually and was a compromise in and of itself, would have extended overtime protections to an estimated 4.2 million workers and strengthened existing overtime protections
to an additional 8.9 million workers.  Under a $35,000 threshold, fewer than half of these workers can expect to benefit from new rulemaking.  This briefing will provide an update on the latest rulemaking, the context in which it is being considered, and allow
for questions and answers.
