We invite you to join us in cosponsoring the DAIRY PRIDE Act, legislation that would prevent non-dairy products made from nuts, seeds, plants, and algae from using dairy terms such as milk, yogurt or cheese on their labels.
Current Food and Drug Administration (FDA) regulations define dairy products as being from dairy animals. Although existing federal regulations are clear, the FDA has not enforced these regulations and the mislabeling of products as ‘milk’, ‘yogurt’ and
‘cheese’ has increased rapidly. This mislabeling hurts dairy farmers who work tirelessly to ensure dairy products meet FDA standards and to provide the public with nutritious food. It has also led to the proliferation of mislabeled alternative products that
contain a range of ingredients and nutrients that are often not equivalent to the nutrition content of dairy products.
FDA has expressed concern over this topic and began a process last fall to review plant-based product labeling. FDA Commissioner Gottlieb has correctly noted that “an almond doesn’t lactate” and that plant-based beverages don’t meet existing standards of
identity. While we are encouraged by FDA’s efforts, we will be reintroducing the Dairy Pride Act to show continued support for a strong rule.
The DAIRY PRIDE Act would require the FDA to issue guidance for nationwide enforcement of mislabeled imitation dairy products within 90 days and require the FDA to report to Congress two years after enactment to hold the agency accountable for this
update in their enforcement obligations.
Consumers should continue to have the option of buying plant-based beverages, but only if they are properly labeled. Addressing this issue is an important, practical step we can take to protect a brand that dairy farmers have worked hard to cultivate and
ensure consumers have a full understanding of what they are purchasing.
