I invite you to join me as an original cosponsor of legislation to ensure Americans with pre-existing conditions are not denied health insurance that covers needed medical care.
As you know, twenty states have brought suit to federal court arguing the entirety of the Affordable Care Act is unconstitutional. If this lawsuit succeeds, individuals with pre-existing conditions will be at risk of being priced-out of health insurance
or being denied outright.
To prevent this from happening, I am introducing legislation to duplicate several consumer protections and insert them into the Health Insurance Portability and Accountability Act (HIPAA), including: 1)
guaranteed issue of health insurance, regardless of health status or pre-existing condition; 2)
community rating (or the prohibition of risk rating based on health status or medical condition); and the
prohibition of excluding or limiting coverage of treatments for pre-existing conditions.
An earlier version of this bill was introduced by Senators Thom Tillis (R-NC), Lamar Alexander (R-TN), Chuck Grassley (R-IA), Bill Cassidy, M.D. (R-LA), Joni Ernst (R-IA), Lindsey Graham (R-SC), John Barrasso (R-WY), Lisa Murkowski (R-AK), Dean Heller (R-NV),
