The House Liberty Caucus urges support for the
Amash Amendment (USA RIGHTS Act) to S. 139, FISA Amendments Reauthorization Act of 2017, and it urges support for final passage upon adoption of the amendment.
The underlying bill reauthorizes Sec. 702 of a law allowing the government to conduct foreign intelligence surveillance programs. The USA RIGHTS Act also reauthorizes Sec. 702, but it makes reforms consistent with the Constitution to protect Americans’ rights.
Under Sec. 702, the government collects and stores massive amounts of Americans’ data. Among other important reforms, the USA RIGHTS Act requires the government to obtain a particularized warrant, upon probable cause, to search Americans’ data.
Members of Congress swear an oath to support and defend the Constitution. Reauthorizing Sec. 702 without substantial reforms is an affront to the Fourth Amendment and violates the rights of the American people.
