Representatives Kelly, Paulsen, Moulton, and Kuster: Please Sign Bipartisan Letter to Protect the Free Flow of Data for Financial Services in Trade and Investment Agreements

Dear Colleague:

An essential part of a successful trade agreement is the inclusion of strong, binding obligations to keep markets open to digital products and services and cross-border data flows.  Preserving the free flow of data matters for businesses of all sizes and types, including the financial services sector, which provides banking, insurance, electronic payment systems, and other services.

Unfortunately, the Trans-Pacific Partnership’s (TPP) data provisions fall short of addressing barriers faced by U.S. financial services institutions.  Increasingly, foreign countries are requiring U.S. companies to “localize” data infrastructure outside of the U.S. by building costly in-country servers and data centers.  Such requirements reduce data security and create inefficiencies, thus eroding U.S. competitiveness.

Therefore, we invite you to sign a bipartisan letter to Secretary Jacob J. Lew (Department of the Treasury), Ambassador Michael Froman (U.S. Trade Representative), and Director Jeffrey Zients (National Economic Council), requesting that their respective agencies address these gaps in the TPP and to prohibit localization requirements in future trade and investment agreements.
